A rental agreement in Hungary can be navigated alone.
You have just emerged from what seemed to be an endless tunnel. That tunnel was the long search for a perfect property in Hungary. But before you go ahead and sign that lease contract, you have to ensure that you understand exactly what you are signing up for. In this post, we’ll be covering some details you need to consider before signing a rental agreement in Hungary, and why it’s important.
Options for a rental agreement in Hungary
In Hungary, there are two different types of rental agreements: controlled and free.
The free rental market is a marketplace where the lessor and the tenant are free to negotiate rent. In this market segment, courts have no power to intervene with the agreed rental amount.
Within eight days of moving in, the landlord has to notify the tenant of the monthly rent amount. If the tenant accepts the notified rent, there are no further steps to be taken and the notified amount becomes the rent amount. If the tenant objects to the notified amount, he or she has to make a written objection to the amount within eight days of receiving the notification.
What part of the legislation specifies my rights and obligations as a tenant in Hungary?
During the rental period, there are a few rights and obligations that all tenants (as well as landlords) will be held accountable for as far as the rent is concerned. Hungarian legislation sets the rules out clearly as specified in Act V of 2013 of the Civil Code. It is also found in Act LXXVIII of 1993 on Residential and Commercial Leases as well as in the municipal regulations adopted by authorisations of acts.
Are all lease agreements done in writing in Hungary?
The simple answer is no. Some landlords prefer having verbal agreements with tenants. The problem with verbal agreements is that the landlord has the ability to terminate the rental agreement if and when he or she pleases. It is essential to always ensure that a formal, written contract has been set up and signed by both the landlord and the tenant before moving into a rental property in Hungary. The reason for this is because without a written contract, the deal could easily be seen as invalid. This is also why it is essential to include all terms and conditions, rights and obligations, payment terms en details like lease duration within the written contract.
Here at Hngary.com, we offer a service that includes a pre-screening of any rental agreement. The service’s fee also includes suggested modificatins to the draft received from the prospective landlord, if any are needed. This service can help prevent costly legal disputes in case of any damage to the property and issues such as refundable deposits.
What about deposits?
Contracting parties involved in the rental agreement are responsible for agreeing on a deposit fee as well as specific conditions. Most landlords request a deposit amount of between one and three months’ worth of rent. Be sure to take pictures of the unit as soon as you move in so that any and all damage claims (and deposit forfeit issues) can be professionally dealt with at the end of your rental period.
