Marriage basics in Hungary
Hungarian law states that the only marriages that are legal in the country are civil marriages. Religious ceremonies are strictly optional and carry no legal value. In Hungary, the legal age for getting married is 18. When a civil marriage is performed in Hungary, it is generally recognised in all other countries.
What are the requirements for getting married in Hungary?
For a couple to get married in Hungary, one of the couple has to be a Hungarian resident, the status of which should be at least 30 days, before marriage may be permitted.
Couples that wish to get married must visit the local registry office where they wish to get married so that they can apply for and obtain a permit. This procedure should generally be started at least 60 days before the wedding date so that all procedures can be completed by the Hungarian authorities in time.
What documents do you need to get married in Hungary?
Before you can get married in Hungary, you will need to gather the following documents:
- Valid passports or ID documents for both applicants as well as the address card of the Hungarian resident
- A document certifying the place of residence
- A Certificate of No Impediment to Marry (if you are a third-country national you can obtain this certificate from your country’s embassy or consulate) or a Certificate of Marital Status (applies to Hungarian citizens)
- Full birth certificates of both applicants indicating the names of their mothers and fathers
- A copy of decree absolute (or decree of divorce) if you have been divorced
- A death certificate if one of the applicants has been widowed
- Additional documents may be required depending on the nationality of each of the future spouses
Keep in mind that all of your official documents have to be translated into Hungarian by the Hungarian Office of Translation and Attestation. No other translation companies are accepted. All documents also need to carry the Apostille stamp.
A registrar will establish if the marriage complies with the Hungarian rule of law since all marriages have to be valid by the laws of the home countries of both parties concerned. Another thing that has to be decided by the registrar is whether or not it is possible to give any future children a certain family name. Couples therefore have to decide whether or not they wish to change their names before the ceremony takes place.
In some cases, certain embassies require that a couple submit a Notice of Marriage that has to be displayed at least 21 days in advance of the wedding. You should check with your relevant consulate or embassy if you are not sure if you have to submit the notice.
